01 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of ChoiceOracle ("Service"), operated by Naseem Asfari ("we," "our," or "us"). By using the Service, you agree to these Terms and our Privacy Policy.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

02 Description of Service

ChoiceOracle is an AI-powered decision simulation engine that helps users analyze potential outcomes of their decisions. The Service uses artificial intelligence to provide insights, predictions, and analysis based on user-provided scenarios.

                    Important: ChoiceOracle provides informational analysis only. It is not a substitute for professional advice (legal, financial, medical, or otherwise). All decisions and their consequences are solely your responsibility.
                

03 User Accounts

To access certain features, you may need to create an account. You agree to:

Keep your account credentials secure
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

04 Acceptable Use

You agree NOT to use ChoiceOracle to:

Violate any laws or regulations
Harm, harass, or threaten others
Generate content that is illegal, hateful, or harmful
Attempt to manipulate or exploit the AI system
Reverse engineer or copy our technology
Use automated systems to access the Service without permission
Interfere with or disrupt the Service
Impersonate others or misrepresent your identity

Zero Tolerance: Violations may result in immediate termination of your account and potential legal action.

05 Intellectual Property

Our Property: ChoiceOracle, including its design, code, algorithms, branding, and content, is owned by Naseem Asfari and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

Your Content: You retain ownership of decisions and scenarios you submit. By using the Service, you grant us a limited license to process your content solely to provide the Service.

Feedback: If you provide suggestions or feedback, you grant us the right to use it without compensation or attribution.

06 Subscription & Payments

Free Tier: Basic access to ChoiceOracle is provided free of charge with limited features.

Paid Plans: Premium features require a paid subscription. By subscribing, you agree to:

Pay all fees associated with your chosen plan
Automatic renewal unless cancelled before the renewal date
Provide accurate billing information

Refunds: Subscription fees are generally non-refundable. We may offer refunds at our discretion on a case-by-case basis.

Price Changes: We may change prices with 30 days notice. Continued use after price changes constitutes acceptance.

07 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not guarantee that:

The Service will be uninterrupted or error-free
AI predictions will be accurate or reliable
Results will meet your expectations
Any errors will be corrected

08 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for any indirect, incidental, special, consequential, or punitive damages
We are not liable for any decisions you make based on ChoiceOracle's analysis
Our total liability is limited to the amount you paid us in the 12 months preceding the claim
If you used the free tier, our liability is limited to $100

Some jurisdictions do not allow limitation of liability, so some of these limitations may not apply to you.

09 Indemnification

You agree to indemnify and hold harmless ChoiceOracle, Naseem Asfari, and our affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any content you submit through the Service

10 Termination

By You: You may stop using the Service at any time. To delete your account, contact us.

By Us: We may suspend or terminate your access at any time, with or without cause, with or without notice. Reasons include but are not limited to violation of these Terms.

Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination will survive.

11 Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.

Dispute Resolution: Any disputes shall be resolved through binding arbitration in Richmond, Virginia, except that either party may seek injunctive relief in court.

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions.

12 Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver.

Assignment: You may not assign your rights under these Terms. We may assign our rights at any time.
